Germany: Information on data processing according to the EU General Data Protection Regulation (GDPR) for visitors to the website and participants in applicant management.

This information (the “Privacy Notice (GDPR)”) describes the processing of personal data by the recruitment agency Mission Talent Germany and the partner agency Mission Talent cc South Africa (hereinafter “Mission Talent” or “we”) when visiting our website and in the context of applicant management, on the basis of the EU General Data Protection Regulation (GDPR). If data processing takes place in Germany, the regulations of the Federal Data Protection Act (BDSG) also apply.

This Privacy Notice (GDPR) also explains the choices you have regarding the processing of your personal data (“data subject rights”) and how you can contact us.

The EU General Data Protection Regulation (GDPR) is also applicable to data processing by Mission Talent cc South Africa insofar as Mission Talent cc offers its services in the European Union and/or processes data of Europeans.

The following rights are available to you as a data subject in principle, insofar as contractual and legal obligations do not conflict with them:

  • Right of access (Art. 15 GDPR) with the restrictions according to Sections 34 and 35 BDSG;
  • Right to rectification of inaccurate data (Art. 16 GDPR);
  • Right to erasure (Art. 17 GDPR) with the restrictions according to Sections 34 and 35 BDSG;
  • Right to restrict the processing of personal data (Art. 18 GDPR);
  • Right to data portability (Art. 20 GDPR);
  • Right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR);
  • Individual right of objection (Art. 21 (1) GDPR) on grounds arising from your particular situation and concerning data processing pursuant to Art. 6 (1)( e) and Art. 6 (1)( f) GDPR;
  • Right to object to the processing of data for advertising purposes (Art. 21 (3) GDPR); you can object to the use of your data for advertising purposes at any time by contacting us at the email address above.

We will not process your data for advertising purposes.

If the data processing is based on consent, you can revoke your consent at any time. The lawfulness of the data processing up to the time of the revocation remains unaffected by this.

The easiest way to exercise your data subject rights is by contacting us using the contact channels listed in section 1. 

The supervisory authority for data protection responsible for Mission Talent Germany is the Berlin Commissioner for Data Protection and Freedom of Information.

Information for visitors to our website

In this section you will find information on the processing of personal data when using the Mission Talent website.

  1. Visiting our website (service and IT security)

When you visit our website, we store certain information about the browser and operating system you use, the date and time of your visit, the access status (e.g. whether you were able to access a website or received an error message), the use of website functions, the search terms you may have entered, the frequency with which you access individual web pages, the name of accessed files, the amount of data transferred, the website from which you accessed our website and the websites you visit from our website, whether by clicking on links on our website or by entering a domain directly in the input field of the same tab (or window) of your browser in which you opened our website. We also store your IP address and the name of your internet service provider for a period of seven days for security reasons, in particular to prevent and detect attacks on our website or attempts at fraud. 

We process the aforementioned personal data on the basis of our legitimate interest in providing you with information about our services on our website and in ensuring IT security for you when you visit our website, on the basis of Art. 6 (1) (f) GDPR.

  1. Contact requests and services

If you have any questions about Mission Talent, the applicant management process or our current job vacancies, you can contact us by email at wewontbite@missiontalent.com. We will process your personal data depending on the subject of your enquiry. If necessary, we may also use personal data that has been stored in our systems pursuant to other data processing activities (e.g., data on previous enquiries, data from an ongoing application process). 

Depending on the enquiry, the data may be processed for the purpose of initiating, implementing or, if applicable, executing a contract with you on the basis of Art. 6 (1)( b) GDPR, for the purpose of fulfilling our legal obligations towards you on the basis of Art. 6 (1)( c) GDPR and/or for the purpose of our legitimate interest in answering your enquiry on the basis of Art. 6 (1)(f) GDPR. The data will be deleted when your request/inquiry has been processed and there are no longer any other storage obligations (e.g., according to the German Civil Code or the German Commercial Code).

  1. Use of the web analysis service Matomo

We use the web analysis service Matomo to analyse and check the use of our website. The statistics obtained enable us to improve our offer and make it more interesting for you as a user. We use a version of Matomo that does not require cookies. Therefore, no Matomo cookies are stored on your device for the purpose of web analysis. For the analysis of website usage, your IP address and information such as timestamp, web pages visited and your language settings are collected. We store the information collected in this way on our server.

We use Matomo with the extension “AnonymizeIP”. This means that IP addresses are processed in abbreviated form and a direct link to a person is excluded. The IP address transmitted by your browser via Matomo is not merged with other data collected by us. The legal basis for the use of Matomo is Art. 6 (1)( f) GDPR.

You can prevent the use of Matomo by removing the following tick and thus activating the opt-out plug-in:

In this case, an opt-out cookie will be- stored in your browser, which will prevent Matomo from storing usage data. If you delete your cookies, the Matomo opt-out cookie will also be deleted. The opt-out must be reactivated when you visit our site again.

  1. Integration of social plug-ins on our website

If we use so-called “social plug-ins” of social networks on our website, we integrate them as follows:

When you visit our website, the social plug-ins are deactivated, i.e. no data is transmitted to the operators of the social networks. If you wish to use one of the social networks, click on the relevant social plug-in to establish a direct connection with the server of that social network. If you have a user account with the social network and are logged in there at the time of activating the social plug-in, the social network can assign your visit to our website, to your social network user account. If you wish to avoid this, you should log out of the social network before activating the social plug-in. A social network cannot assign a visit to a website until you have also activated a social plug-in at that website. If you activate a social plug-in, the social network transmits the content that becomes available as a result directly to your browser, which integrates it into our website. In this situation, data transmissions may take place that are initiated and controlled by the relevant social network. Your connection to a social network, the data transfers that take place between the social network and your system, and your interactions on this combined platform, are governed exclusively by the data protection provisions of the relevant social network. The social plug-in remains active until you deactivate it or delete your cookies.

When you click on the link to an offer or activate a social plug-in, personal data may be transferred to providers in countries outside the European Economic Area which, from the perspective of the European Union (“EU”), do not ensure an “adequate level of protection” for the processing of personal data in line with EU standards. Please bear this in mind before clicking on a link or activating a social plug-in and thereby triggering a transfer of your data.

Information for participants in the applicant management process

In the following section, we provide you with an overview of how we process your personal data as a participant in the applicant management process.  As recruiters, we search and find executives for top positions in organisations that drive change, all over the world. The central legal basis for processing your data as part of the selection process for our clients and your possible future employers is Article 6 (1)( b) GDPR and, where applicable, Section 26 (1) BDSG. These legal bases also apply if the pre-contractual measures or the establishment of an employment relationship are not in relation to Mission Talent, but to your possible future employers.

  1. Categories of personal data

Personal data is any information relating to an identified or identifiable natural person. This includes, for example, your name, your (official and private) contact details, your address, hobbies or information about illnesses and tax status (with religious affiliation). We treat all the information you send us as application data, in addition to your curriculum vitae, your photo, any information on your state of health or other private information. 

Insofar as special categories of personal data are processed pursuant to Art. 9 (1) GDPR, this is for the purpose of the exercise of rights or the fulfilment of legal obligations under labour law, social security law and social protection law (e.g. informing the representative body for severely disabled persons German Social Code IX Section 81) in relation to our client and your possible future employer within the scope of the selection procedure. This is done on the basis of Art. 6 (1)( c), Art. 9 (2)(b) GDPR in conjunction with Section 26 (3) BDSG. We process your personal data that you provide to us as part of your application. This includes both your application documents and the information you provide in person during the application process, e.g. in telephone interviews and personal interviews or during a visit to a trade fair. For a comprehensive assessment of your application, we always need your curriculum vitae as well as certificates or corresponding evidence. Further information, including a photo or video, is voluntary.

  1. Applications via our online application platform

Mission Talent uses various internet platforms (XING or LinkedIn) as well as its own website to search for suitable applicants. The advertisements and job advertisements published via these internet platforms and our own website, as well as the applications received as a result, are processed centrally with the help of our applicant management tool. When using the applicant management tool to submit an application, the legal basis is Art. 6 (1)( b) GDPR, if applicable in conjunction with Section 26 BDSG. 

The data transmitted via the applicant management tool is stored and processed by the service provider TrackerRMS, which is based in the United Kingdom. This service provider acts on our behalf within the scope of commissioned processing in accordance with Art. 28 GDPR.

  1. Data collection not directly from the data subject

We process the data provided as part of your application for the purpose of reviewing your application and suitability for the advertised position. For this purpose, we also collect personal data that we have permissibly obtained from publicly accessible sources (such as professional networks like LinkedIn and XING). The legal basis for this data processing is Art. 6 (1)( f) GDPR.

  1. Mission Talent`s applicant pool

If we were unable to consider your application for a specific position, in some cases we would still like to store your application in our applicant pool so that we can refer back to it when a vacancy arises. When submitting your application via our applicant management tool, you have the option of giving your consent for us to store your application documents for up to three years. The legal basis in this respect is Art. 6 (1)( a) GDPR. After three years or if you revoke your consent, we will delete your data.

  1. Recipients and categories of recipients of the data

You can find a detailed description of how the application process is carried out at Mission Talent, which data is processed in the process, and at what time which data is transferred to our clients in the information “Mission Talent’s Process and Your Personal Data”. The legal basis for the transfer of your data to your future potential employers is Article 6 (1)( b) GDPR, possibly in conjunction with Section 26 BDSG.

  1. Transfer of data to a third country or an international organisation

Data is only transferred to countries outside the EU or the EEA (so-called third countries) if this is necessary to carry out the recruitment assignment (e.g., because your future potential employer is based there), if it is required by law, if you have given us your consent or within the framework of commissioned data processing. If service providers are used in a third country, which is currently not the case, they are obliged to comply with the level of data protection required in Europe by taking appropriate measures (e.g., agreeing to the EU standard contractual clauses and, if applicable, doing a data transfer impact assessment) in addition to written instructions.

  1. Duration of data storage

After completion of the applicant selection process, we will keep your application documents for another 6 months. Subsequently, and unless you have given your consent for your data to be stored in our applicant pool, the data will be deleted and any copies destroyed. Irrespective of the storage period described above, we store your pure master data (title, first and last name, address as well as date of birth and the reason for rejection) for a period of 12 months after completion of the application process, provided that we were unable to place you with our client. We require this data in order to recognise and prevent duplicate applicants and for the creation of recruiting key figures. The legal basis for this is Art. 6 (1)( f) GDPR.

Information for visitors to our social media accounts

Mission Talent has a presence on the following social media platforms. The aim of our social media presence is to inform you about our projects and actions and exchange ideas with you on relevant topics.

  1. LinkedIn 

We have a social media presence on LinkedIn and use its services (LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland). Your use of this platform and its functions are your own responsibility. This applies in particular to the use of the interactive functions (e.g., commenting, sharing, rating, applying). The way in which LinkedIn collects and processes your data and the purposes for which this is done can be found in LinkedIn’s data protection policy, which you can find at https://www.linkedin.com/legal/privacy-policy?trk=lithograph_footer-privacy-policy.

When you visit LinkedIn, cookies and similar technologies such as pixels, web beacons and local storage may be used to collect information about your use of the platform and to provide features to you. In addition, advertisers or other partners of LinkedIn may store cookies or similar technologies on your device. Information on how to contact LinkedIn and how it uses your data for its own purposes or passes it on to third parties can be found in LinkedIn’s privacy policy https://www.linkedin.com/legal/privacy-policy?trk=lithograph_footer-privacy-policy

You have the option of restricting the processing of your data in the privacy settings of your LinkedIn profile. Information on the privacy settings can be found here (with further references): https://www.linkedin.com/help/linkedin/answer/66?trk=microsites-frontend_legal_privacy-policy&lang=de. You may also be able to restrict the platform’s access to contact and calendar data, photos, location data, etc. on mobile devices in the privacy settings, depending on the operating system used.  

The data you enter on LinkedIn, in particular your username and the content published under your account, are processed by us insofar as we share or reply to your posts, or write our own posts that refer to your profile, and this content is made accessible to our followers. This data is processed on the legal basis of Art. 6 (1)( f) GDPR.

  1. XING

We operate a XING account and use this to maintain business contacts, draw attention to our services (including job advertisements) and to get in touch with you as a visitor and user. Please be careful with respect to the information you share with us and publish on XING, and in how you interact with our content (rate, comment, share etc.). XING grants itself the right to use this content and the usage data collected through it for its own purposes. As a visitor, your use of XING is your own responsibility. You can find the same or similar relevant information about our services or job advertisements on our website. If you would like to avoid information or data being processed by XING, we will also be happy to help you via e-mail.

We are only a data controller according to the GDPR if we process your data transmitted via XING for our own purposes.  XING also processes your data for its own purposes. The social network XING is operated by XING SE, Dammtorstraße 30, 20354 Hamburg, Germany. You can find out more information about XING’s data processing activities at https://privacy.xing.com/de/datenschutzerklaerung.

We have no influence on how and to what extent XING processes your data that it collects when you use the platform. We are not aware of the location or the duration of XING’s data storage, or of any data transfers to third parties. If XING processes your data for its own purposes, then XING is the data controller in accordance with the GDPR.  

We process your data when you contact us, i.e., send us a message. You can do this on XING by, for example, by using the messenger function or a contact form. Mandatory fields may be displayed and are found on the form. We process your data in order to reply to your message, i.e., to contact you in return. In this activity, your data (if necessary) will be stored in our IT system. We base this data processing on our legitimate interest pursuant to Art. 6 (1)( f) GDPR (answering your enquiry). If a contract is initiated as a result of your enquiry, we also process your data in accordance with Art. 6 (1)( b) GDPR. 

Information on the use of Zoom communication software

We use the tool Zoom on the basis of our licence agreement [Zoom Pro version 5.0] to conduct telephone conferences, online meetings, video conferences and/or webinars (hereinafter: “Online Meetings”). Zoom is a service belonging to Zoom Video Communications, Inc., 55 Almaden Boulevard, 6th Floor, San Jose, CA 95113, which has its registered office in the USA. For all Online Meetings, as far as technically possible, we have activated end-to-end encryption in our Zoom configuration. Furthermore, we have set up the Zoom configuration in such a way that only data centres in the EU, the EEA or secure third countries such as Canada or Japan are used to conduct Online Meetings. Various types of data are processed when using Zoom. The scope of the data also depends on the data you provide before or during participation in an Online Meeting. 

The following personal data are subject to processing:

  • User details: first name, last name, telephone (optional), e-mail address, password (if “single sign-on” is not used), profile picture (optional), department (optional)
  • Meeting metadata: topic, description (optional), participant IP addresses, device/hardware information.
  • For recordings (optional): MP4 file of all video, audio and presentation recordings, M4A file of all audio recordings, text file of the online meeting chat.
  • When dialling in by phone: information on the incoming and outgoing call number, country name, start and end time. If necessary, further connection data such as the IP address of the device can be saved.
  • Text, audio and video data: You may have the opportunity to use the chat, question or survey functions in an Online Meeting. In this respect, the text entries you make are processed in order to display them in the Online Meeting and, if necessary, to record them. In order to enable the display of video and the playback of audio, the data from the microphone of your terminal device and from any video camera of the terminal device are processed accordingly during the Online Meeting. You can switch off or mute the camera or microphone yourself at any time via the features on the Zoom platform.

You can provide further information about yourself, but you do not have to. You are free to use the chat function during the Online Meeting and you can also switch your camera and microphone on, off or mute yourself. By default, the camera and microphone are deactivated at the beginning of an Online Meeting. In order to participate in an Online Meeting or to enter the “meeting room”, you must at least provide your name. If we want to record Online Meetings, we will transparently inform you of this in advance and – where necessary – ask for consent. The fact of the recording will also be displayed to you in the Zoom app. If it is necessary for the purposes of logging the results of an Online Meeting, we will log the chat content. However, this will not usually be the case. In the case of webinars, we may also process questions asked by webinar participants for the purposes of recording and following up webinars. If you are registered as a user at Zoom, then reports on Online Meetings (meeting metadata, telephone dial-in data, questions and answers in webinars, survey function in webinars) can be stored at Zoom for up to one month.

The legal basis for data processing when conducting Online Meetings is Art. 6 (1)(b) GDPR, insofar as the meetings are conducted within the framework of contractual relationships. Should no contractual relationship exist, the legal basis is Art. 6 (1)( f) GDPR. Here, too, our interest is in the effective conduct of Online Meetings.

As a matter of principle, we do not pass on your data to third parties. Data is only passed on if it is intended to be passed on, if you have expressly consented to the transfer beforehand or if we are obliged or entitled to do so by law. 

When processing your data, Zoom Video Communications Inc. supports us as an external service provider and processor within the meaning of Art. 28 GDPR. As a processor, Zoom Video Communications Inc. processes your data strictly in accordance with instructions and on the basis of a separately concluded data processing agreement. The data processing may also take place outside the EU or the EEA. With regard to Zoom Video Communications Inc., an adequate level of data protection pursuant to Article 46 (2)( c) of the GDPR can be assumed through the use of EU standard contractual clauses and other appropriate measures (setting up end-to-end encryption and using the data routing function, as this means that you can determine yourself through which data centres the data should flow during Online Meetings and webinars). If you access Zoom website, the provider of Zoom is responsible for the processing of any data from that activity. However, accessing the Zoom website is only necessary in order to download the Zoom app software. You can also use Zoom if you enter the respective meeting ID and, if applicable, further access data for the meeting directly in the Zoom app. If you do not want to or cannot use the Zoom app, the basic functions can also be used via a browser version, which you can also find on the Zoom website.

Changes or additions to this information on data processing

Mission Talent reserves the right to change or supplement this information on data processing at any time in compliance with legal requirements. This may be the case, for example, in order to comply with new legal provisions or to take new services into account. We therefore recommend that you check our website at regular intervals to find out about our current data processing and check for any changes.

  • Withdraw consent to our use of your information at any time where we rely on your consent to use or process that information. Please note that if you withdraw your consent, this will not affect the lawfulness of our use and processing of your information on the basis of your consent before the point in time when you withdraw your consent.

We will not process your data for advertising purposes.

The personal information that we process may include, for example, your name, your (official and private) contact details, your address or hobbies. We treat all of the information that you send us as application data. This may include your application documents, the information you provide in person during the application process (e.g., in telephone interviews and personal interviews or during a visit to a trade fair). Application data may also include personal information that is defined as “special personal information” under POPIA, for example information about your race or ethnicity, biometric data, information about your health, and information about criminal behaviour to the extent that the criminal behaviour related to an alleged offence or proceedings regarding an alleged offence. Where we process “special personal information we shall only do so with your consent.

The advertisements and job advertisements published via these internet platforms and our own website, as well as the applications received as a result, are processed centrally with the help of our applicant management tool. When using the applicant management tool to submit an application, the legal basis of our processing is the performance of a contract with you (or where you have asked us to take steps prior to entering into a contract). 

The data transmitted via the applicant management tool is stored and processed by the service provider TrackerRMS, which is based in the United Kingdom. This service provider is required to take appropriate security measures to protect your personal information in line with our policies. We do not allow this service provider to use your personal information for their own purposes and we only permit them to process your personal information for the specified purpose and in accordance with our instructions.

  1. Data collection not directly from the data subject

We process the personal information provided as part of your application for the purpose of reviewing your application and suitability for the advertised position. For this purpose, we also collect personal information that we have permissibly obtained from publicly accessible sources (such as professional networks like LinkedIn and XING). The legal basis of our processing is the performance of a contract with you (or where you have asked us to take steps prior to entering into a contract).

  1. Mission Talent`s applicant pool

If we were unable to consider your application for a specific position, in some cases we would still like to store your application in our applicant pool so that we can refer back to it when a vacancy arises. When submitting your application via our applicant management tool, you have the option of giving your consent for us to store your application documents for up to three years. The legal basis of our processing is the performance of a contract with you (or where you have asked us to take steps prior to entering into a contract). After three years or if you revoke your consent, we will delete your personal information.

  1. Duration of data storage

After completion of the applicant selection process, we will keep your application documents for another 6 months. Subsequently, and unless you have given your consent for your data to be stored in our applicant pool, the data will be deleted and any copies destroyed. Irrespective of the storage period described above, we store your pure master data (title, first and last name, address as well as date of birth and the reason for rejection) for a period of 12 months after completion of the application process, provided that we were unable to place you with our client.
